ADVERTISERS/ADVERTISING LANDLORDS: TERMS AND CONDITIONS TO OBSERVE PRIOR TO SUBMITTING A PROPERTY ADVERTISEMENT.
1. PERMISSIONS AND OWNERSHIP OF ADVERTISED PROPERTY
1.1 The advertiser of the property must have the permission from the property owner and/or co-owner/s to advertise this property on Houseflys.
1.2 If the advertiser of a leasehold property or has the right to ‘sub-let’ within a property that has an existing tenancy agreement, that the advertiser has the permission of the superior landlord/owner of the property, to advertise the property on their behalf.
1.3 The advertiser of the property guarantees that the advertised property is the actual and real property to let and that it isn’t a fraudulent non-existent property used to elicit rent deposits prior to a tenant viewing or signing a tenancy agreement.
1.4 The advertiser of the property will not ask for a deposit or a holding deposit to secure the property prior to the interested Houseflys enquirer viewing the advertised property.
1.5 Houseflys will not be held liable if an advertiser landlord has provided misleading information which results in the enquirer and/or subsequent tenant of the advertised property incurring financial loss or the loss of the tenancy of the advertised property.
1.6 Houseflys will not be held liable if an advertiser has falsely stated that permission to advertise the listed property ‘to-let’ has not secured the permission/s of the landlord/superior landlord, owner or co-owners of the advertised property. If an advertiser does ask for a holding deposit before viewing the property, once Houseflys has been notified of this practice by an enquirer, site visitor or property viewer, we will delete the property details, images and landlord contact details from the site.
2. RENT CHARGES QUOTED ON ANY ADVERTISED PROPERTIES
2.1 Houseflys is not responsible for setting the amount of rent for each advertised property, it is the responsibility of the landlord/advertiser to clearly show on each advertised property the expected rent to be charged; and the enquirer has the responsibility to establish any rent and additional charges relating to the renting of any advertised property during future landlord enquiries.
3. CONDITION OF ADVERTISED PROPERTIES AND COMPLIANCE WITH STATUTORY OBLIGATIONS AND REGULATIONS
3.1 Houseflys has not viewed any of the properties advertised on this site and will not be held responsible for and will accept no liability of any discrepancies between the advertised detailed information and the actual condition/facilities of the advertised property; it is the responsibility of the advertiser/landlord to provide accurate updated information on advertising the property and/or during any subsequent enquiries or viewings received.
3.2 Equally, Houseflys is not liable or responsible to establish whether advertisers/advertising landlords are compliant with their statutory obligations and current regulations; Houseflys encourages all enquirers to fully establish and satisfy any queries they may have about an advertised property, directly with the advertiser/advertising landlord either prior to any viewing or uptake of a tenancy.
4. DETAILED DESCRIPTIONS OF ADVERTISED PROPERTIES
4.1 On submitting a property to be advertised, the advertising landlord/advertiser has the option of providing detailed descriptions and images of their property and is ultimately responsible for information they advertise on this site.
4.2 It is the responsibility of the advertising landlord/advertiser to update the detailed descriptions of their advertised property if required and/or when re-submitting subsequent advertising of the same property.
5. EXPIRY DEADLINES OF ADVERTISED PROPERTIES
5.1 All advertisements are subject to an expiry deadline, as specified by advertisers selected advertising dates and payment options; once an advert expiry date is imminent an automated email to the advertiser will be sent requesting if they wish the property advert to be re-advertised on Houseflys website; the advertiser has the option to re-advertise or not.
5.2 If an advertiser wishes to re-advertise at the end of the expiry deadline, it is the advertisers responsibility to re-submit the property advert and payment to Houseflys, which can be done either by following a link from the automated email or by going direct to the site and entering their property reference number and login and selecting the re-submit option and payment.
5.3 If Houseflys does not receive any request to resubmit at the end of the expiry deadline, the property advert will be removed from the website and will no-longer be advertised until further instructions and payments are received direct from the advertiser.
5.4 Houseflys will retain all the property descriptions and images for 1 year exactly from the date of the initial advert of the property; this is to enable subsequent re-advertising of the property by the landlord/advertiser quickly and easily, however it is the responsibility of the landlord to provide accurate updated images, descriptions and information at the time of each subsequent advertisement.
5.5 If the property is not subsequently re-advertised following the initial first advertisement during the following year, Houseflys will delete all property details, images, information and landlord contacts exactly 1 year from the date of the initial property advertisement.
5.6 If a landlord wishes to re-advertise the same property after the 1 year has lapsed and all the details have been deleted, the landlord will have to reload all the property details, images and landlord contact/payment details again.
5.7 Houseflys will not be held liable if property details, images and landlord contact information are lost following a technical fault or failure before the 1st year following the initial advert has lapsed.
5.8 Advertisers can contact Houseflys to request that their property details, images and landlord contact information by deleted prior to the automatic yearly deletion has been completed.
6. PAYMENTS OF ADVERTISING
6.1 All adverts will be paid in advance and at the time of submitting the property for advertisement.
6.2 On receipt of payment and property advertisement, the advertisement will be uploaded to Houseflys website with immediate effect.
6.3 Houseflys uses the services of PayPal for the management of securing online payment transactions for advertising, please ensure that you also agree with PayPal's Terms and Conditions prior to payment, as Houseflys will not be liable for loss of payment details provided to PayPal.
7. LIMITATION OF LIABILITY AND INDEMNITY
7.1 Advertisers/advertising landlords and searching visitors/tenants recognise and accept that Houseflys is a web based advertising platform solely.
7.2 The aim of Houseflys is to provide a web platform to enable private landlords to advertise their To Let properties and rooms to a broader market.
7.3 Houseflys is not a ‘Letting Agent’ acting on behalf of advertisers.
7.4 Therefore, Houseflys will not be held liable for any loss of profit, business, damage or liability to advertisers or searching visitors/tenants however caused, or whether or not any such loss was foreseeable.
7.5 Website visitors/interested enquirers and searching tenants can choose or not to make the initial contact with advertisers/landlords at their own discretion. Houseflys has not viewed any of the properties advertised on this site and will not be held responsible for and will accept no liability of any discrepancies between the advertised detailed information and the actual condition/facilities of the advertised property; it is the responsibility of the advertiser/landlord to provide accurate updated information on advertising the property and/or during any subsequent enquiries or viewings received.
7.6 Equally, Houseflys is not liable or responsible to establish whether advertisers/advertising landlords are compliant with their statutory obligations and current regulations; Houseflys encourages all enquirers to fully establish and satisfy any queries they may have about an advertised property, directly with the advertiser/advertising landlord either prior to any viewing or uptake of a tenancy.
8. USE OF PERSONAL INFORMATION PROVIDED BY ADVERTISERS
8.1 Houseflys will endeavour to keep safe all personal data and property details/images uploaded onto Houseflys website, as provided by registered advertisers.
8.2 Houseflys has ensured that data storage is kept safe on secure servers which are backed-up daily.
8.3 Houseflys will not pass on any personal information held by Houseflys, to any 3rd party or company, however if any advertiser is deemed to be using the Houseflys website for fraudulent purposes, Houseflys will disclose information to help assist investigating authorities.
8.4 Houseflys will use advertiser’s information to help develop the service provided. We will, on occasion, use your details to contact you direct for market research and offers, however, if you would like to ‘opt out’ please don’t hesitate to let us know at the time or via email: info@houseflys.co.uk.
8.5 Houseflys will only contact advertisers via the telephone numbers and email address that advertisers provide during registration. Houseflys will never send you mail via the post. Houseflys can be contacted directly by the telephone numbers listed on the CONTACT US page and at the times listed, alternatively we welcome contact via email or text messaging, which we will respond to within 24 hours.
9. INAPPROPRIATE SUBMISSION OF OFFENSIVE CONTENT
9.1 Advertisers are reminded that the use of inappropriate and offensive text or image content on and within Houseflys website is not allowed and will be removed without the advertisers consent.
9.2 Descriptions of properties and/or the suitability of tenants must not be offensive to any group, individual, race, disability, gender or religion and must comply within the Race Discrimination Act, Disability Discrimination Act and any other legislation that applies at the time of advertisement listing.
10. REPORTING INAPPROPRIATE OR OFFENSIVE CONTENT TO HOUSEFLYS
10.1 Houseflys actively encourages visitors to report listings immediately to us, if they have any concern with regard to each individual listing that appears on Houseflys.
10.2 If you notice an offensive listing which includes offensive text, descriptions, discriminatory language or images, contact Houseflys immediately either by clicking the ‘Report This Listing’ button at the top right-hand side of each property/room listing OR by contacting us directly on the telephone numbers listed on the CONTACT PAGE.
10.3 Any listing that is deemed to have broken the law in relation to legal legislation, will be forwarded to the relevant investigating authorities.
11. REPORTING FRAUDULENT ADVERTISERS AND/OR PROPERTIES
11.1 Houseflys actively wants to discourage fraudulent advertisers from using Houseflys website.
11.2 Houseflys also wants to actively encourage all visiting enquirers to safeguard themselves against possible fraudulent ‘Property or Room To Let’ Scams. You can do this by the following means:
11.3 Contact Houseflys direct if you have any queries or concerns about any of the properties or rooms listed on Houseflys. Houseflys will investigate any possible fraudulent listing immediately.
11.4 Prior to listing any property or room to let on Houseflys, advertising landlords have to agree to Houseflys Terms and Conditions.
11.5 Prior to their listing being uploaded ‘live’ on to Houseflys website, all advertising landlords agree NOT to charge any ‘viewing fees’ or request a ‘viewing holding deposit’ before an enquirer attends a viewing of a property or room listed on Houseflys.
11.6 Please notify Houseflys immediately if you are ever asked for a ‘viewing fee/charge’ or a ‘viewing holding deposit’ before any viewing of a property or room listed on Houseflys.
11.7 Houseflys recommend that you do not hand over any ‘viewing fee/charge or deposits’ BEFORE any viewing of a property or room listed on Houseflys.
NOTE: Landlords do not have any legal right to charge a viewing fee and the majority wouldn’t even expect to request such a charge – the only time a landlord would ask for a ‘holding deposit’ is AFTER you have viewed a property/room and have stated that you are interested in taken up the tenancy/room. Landlords would then request a ‘holding deposit’ generally around the £50 mark to cover any future advertising, should you subsequently pull out of the property/room. Obtain a receipt stating the landlord’s full name and address and amount of the holding deposit. Landlords generally deduct your original £50 Holding Deposit from your ‘Tenancy/Inventory Deposit’ once you move in.
12. COPYRIGHT, BRANDING AND INTELLECTUAL PROPERTY OF HOUSEFLYS
12.1 All of the text, imagery, branding and intellectual property of Houseflys and belongs solely to Houseflys and Houseflys contracted licensed sources under Copyright.
12.2 Houseflys welcomes visitors and advertisers to download and print off advertised listings for their own personal use but the copyright remains the property of Houseflys and must not be used for commercial purposes.
12.3 Advertisers that list their property details and images on Houseflys retain the copyright of their images and descriptions and have the ability to delete their property/room listings as they see fit. Houseflys will delete any unused property/room listings after 1 year of non-use.
12.4 If visitors are interested in using any of the material, text, imagery, branding or intellectual property of Houseflys, must, in the first instance contact Houseflys to obtain permission OR if visitors are interested in images uploaded directly by the advertiser that they must contact the advertiser direct to seek permission of use.
13. LEGISLATION AND GOVERNING LAWS TO MANAGE DISPUTES
13.1 If visitors or advertisers have any concerns or disputes directly as a result of the Houseflys website, service or administration, Houseflys encourages you to CONTACT US in the very first instant.
13.2 Houseflys will work towards a resolution with you direct, but if you feel that your complaint or dispute is unresolved, Houseflys encourages you to refer your dispute to current legislation which is governed under English Law, which shall be subjected to the jurisdictions of England and Wales Court systems.
